Terms & Conditions of Use and Sale

These Terms & Conditions ("Terms") apply to your use of this website and to every quote, order and sale made by Total Auto Parts LLC, doing business as Total Auto Parts Direct ("we," "us," "our"). By using this website, requesting a quote or placing an order, you agree to these Terms and to our other policies linked below. If you do not agree, please do not use the website or place an order.

1. Quotes and orders

• We sell parts on a quote basis. A quote request on this website is not an order and does not require payment.
• Price, availability, shipping charges, taxes and warranty period are confirmed with you in writing (email or invoice) before you approve an order.
• An order is accepted only when we confirm it in writing and receive payment or an agreed payment arrangement. We may decline or cancel any order, for example because of stock, pricing errors, inability to verify fitment, or suspected fraud (see our Payment Policy and Cancellation Policy).
• Quotes are valid only for the period stated on the quote, and while the part remains in stock.

2. Used parts and fitment

Unless your quote or invoice says otherwise, the parts we sell are used original equipment (OEM) parts taken from other vehicles. Used parts may show normal wear and cosmetic imperfections. It is your responsibility to confirm that a part fits your vehicle by checking the VIN, engine, trim, mounting position and OEM part number with us before purchase. A year/make/model match alone is not a guarantee of fitment. Photos are representative. See our Disclaimer.

3. Prices and payment

All prices are in US dollars. Prices, descriptions and availability may change without notice and may contain errors; we may correct errors and cancel affected orders (with a full refund of any amount paid). Sales tax is added where required by law. See our Payment Policy.

4. Shipping, title and risk of loss

Shipping is governed by our Shipping Policy. Title to the part passes to you when we receive full payment. Risk of loss or damage passes to you when the carrier delivers the part to the address you gave us; we will help you with any carrier damage claim as described in the Shipping Policy.

5. Returns, refunds, cancellations, warranty and cores

These are governed by our Return Policy, Refund Policy, Cancellation Policy, Warranty Policy, Core Charge Policy. Those policies are part of these Terms. If your written quote or invoice states a different term for your order, the quote or invoice controls for that order.

6. Warranty disclaimer

Our only warranty on a part is the limited warranty described in our Warranty Policy (90 days for engines, transmissions and transfer cases; 30 days for other parts), unless your written quote says otherwise. To the fullest extent permitted by law, we make no other warranties, express or implied, and any implied warranty, including merchantability or fitness for a particular purpose, is limited in duration to the applicable limited warranty period. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. Nothing in these Terms limits any right you have under applicable law that cannot be waived.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including labor or installation costs, towing, rental vehicles, loss of use, lost profits, or damage to other parts or vehicles, arising from the use of any part or this website. Our total liability for any claim relating to a part is limited to the amount you paid us for that part. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Installation and safe use

Installation by a licensed, qualified mechanic is strongly recommended, especially for brake, steering, suspension, fuel, airbag-related and drivetrain components. You are responsible for proper installation, for verifying the part before installing it, and for operating your vehicle safely and lawfully, including any applicable emissions and equipment regulations in your state.

9. Use of this website

• Use the website only for lawful purposes and in good faith.
• Do not attempt to disrupt, scrape, hack or misuse the website, or submit false or fraudulent information.
• The content, logos and design of this website belong to us or our licensors and may not be copied or reused without permission. Vehicle makes, models and part numbers are named only to identify compatibility; we are not affiliated with or endorsed by any vehicle manufacturer.
• The website is provided "as is" and may be unavailable or contain errors from time to time.

10. Privacy and communications

Our Privacy Policy explains how we handle personal information. By giving us your email and phone number you agree we may contact you about your quote or order.

11. Governing law and disputes

These Terms and any dispute relating to them or to a purchase are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Please contact us first so we can try to resolve any issue in good faith. Any legal action must be brought in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction, except where your local consumer-protection law gives you the right to bring a claim elsewhere.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We are not liable for delay or failure caused by events beyond our reasonable control (such as severe weather, carrier disruption or supplier shortages). We may update these Terms at any time; the version posted on the website when you place an order applies to that order. These Terms, with the linked policies and your written quote or invoice, are the entire agreement between you and us.
